Terms of Service

1. Acceptance of Terms

By accessing or using the TrustFlow API ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

TrustFlow provides a Governance-as-a-Service API for evaluating transaction risk in AI agent workflows. The Service includes:

  • Transaction risk evaluation (POST /v1/evaluate)
  • Risk configuration management
  • Transaction history and analytics
  • Webhook notifications
  • Usage metering and billing

3. Account Registration

  • You must provide accurate registration information
  • You are responsible for maintaining the security of your API key
  • You must notify us immediately of any unauthorized access
  • One account per entity; no account sharing

4. API Keys and Security

  • API keys are shown once at creation and cannot be recovered
  • You must not share, publish, or embed API keys in client-side code
  • You are responsible for all activity under your API key
  • We reserve the right to rotate or revoke keys if abuse is detected

5. Usage Plans and Billing

5.1 Plans

  • Free — $0/month, 100 evaluations/hour
  • Pro — $49/month, 10,000 evaluations/hour
  • Enterprise — Custom pricing, unlimited

5.2 Billing

  • Billing is monthly, charged in advance via Stripe
  • Usage overages on Enterprise plans are billed at the agreed per-evaluation rate
  • All prices are in USD, exclusive of applicable taxes
  • Refunds are at our sole discretion

5.3 Plan Changes

  • Upgrades take effect immediately
  • Downgrades take effect at the end of the current billing period
  • No pro-rated refunds for mid-cycle downgrades

6. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Attempt to circumvent rate limits or security measures
  • Reverse-engineer, decompile, or extract the risk scoring algorithm
  • Resell, sublicense, or redistribute the Service without authorization
  • Send malicious, abusive, or fraudulent data to the API
  • Use the Service to facilitate money laundering, terrorist financing, or fraud

7. Service Level

7.1 Availability

  • Free / Pro: Best effort availability, no SLA
  • Enterprise: 99.9% monthly uptime SLA (defined in separate agreement)

7.2 Latency

Target evaluation latency: <50ms (p95). This is a target, not a guarantee, for Free and Pro plans.

7.3 Maintenance

We may perform scheduled maintenance with 48 hours advance notice. Emergency maintenance may occur without notice.

8. Data Processing

  • We process transaction data solely to provide the Service
  • We do not sell, share, or use your data for advertising
  • Data processing is governed by our Privacy Policy and DPA
  • Transaction data is retained for 90 days (Free), 1 year (Pro), or as agreed (Enterprise)
  • You may request data deletion at any time

9. Intellectual Property

  • TrustFlow, its risk scoring algorithm, and all associated IP are owned by TrustFlow SL
  • You retain ownership of your data submitted to the Service
  • You grant us a limited license to process your data to provide the Service
  • Our SDK is licensed under MIT; the API itself is proprietary

10. Limitation of Liability

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY
  • TrustFlow provides risk scores and recommendations — NOT financial advice
  • You are solely responsible for how you act on TrustFlow's evaluations
  • Our total liability is limited to fees paid in the 12 months prior to the claim
  • We are not liable for indirect, incidental, or consequential damages

11. Indemnification

You agree to indemnify TrustFlow against any claims arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

12. Termination

  • Either party may terminate with 30 days written notice
  • We may suspend access immediately for Terms violations
  • Upon termination, your API keys are revoked and data is deleted per our retention policy

13. Governing Law

These Terms are governed by the laws of Spain. Disputes shall be resolved in the courts of Madrid, Spain.

14. Changes to Terms

We may modify these Terms with 30 days notice via email. Continued use after notice constitutes acceptance.
